This notice explains how personal information is handled when you visit Fortunato.ph, contact us, request a demonstration, or otherwise interact with our public website and services.

1. Introduction

Fortunato.ph respects the privacy of website visitors, prospective clients, cooperative representatives, and platform users. We process personal information responsibly and in accordance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and applicable issuances of the National Privacy Commission.

This notice primarily covers the Fortunato.ph public website and its inquiry and demonstration-request forms. A cooperative using the Fortunato.ph platform may separately be responsible for personal information it controls within its own instance and for providing appropriate privacy information to its members, personnel, and other data subjects.

2. Who we are

Fortunato.ph is a cooperative management software product founded by Emerson and commercially operated in the Philippines by NxtStory Studios Inc. (SEC Registration No. 2024030141531-13) under an authorized product commercialization arrangement. Fortunato.ph is a product identity and is not represented as a separately incorporated company.

NxtStory Studios Inc. is the Philippine-registered operating entity responsible for handling inquiries and demonstration requests submitted through the Fortunato.ph public website.

3. Information we collect

Information you submit

The Request a Guided Demo form asks for your full name, position or role, cooperative or organization name, email address, optional mobile number, approximate number of active members, selected plan of interest, and the operational processes or notes you provide.

The Contact form asks for your full name, email address, and message or question. Please avoid including sensitive personal information that is not necessary for your inquiry.

Website and analytics information

If you consent to optional analytics, Google Analytics 4 may process information about visits and interactions on the homepage and certain designated public routes, such as page location and title, browser or device information, timestamps, and technical identifiers made available through the browser. Information entered in the inquiry forms is not included in analytics events.

4. Purpose of collection

We use submitted information to respond to inquiries, schedule and tailor product demonstrations, understand operational requirements, prepare proposals or quotations, provide requested information or services, communicate with prospective clients, and manage the resulting business relationship.

Technical and analytics information may be used to understand website usage, diagnose performance or security issues, and improve the website experience. Submitting a public inquiry form does not automatically enroll you in a separate marketing mailing list. Any optional direct-marketing activity will be presented separately with an appropriate choice and controls.

6. Disclosure and third-party services

Authorized Fortunato.ph and NxtStory Studios Inc. personnel may access public inquiries when needed for sales, demonstrations, service delivery, administration, security, or legal compliance. Form submissions are routed to designated business recipients through email services.

Relevant service-provider categories include application hosting and infrastructure providers, email-delivery providers, Google Analytics, security and technical support providers, and professional advisers when reasonably necessary. These providers may process information on our behalf or under their own applicable terms. We may also disclose information where required by law, lawful process, or to establish, exercise, or defend legal claims.

7. Data retention

Public form submissions and related correspondence are retained only for as long as reasonably necessary to address the inquiry, manage a prospective or active business relationship, meet security and audit needs, and comply with applicable legal obligations.

Retention periods may vary according to the nature of the interaction and applicable requirements. When information is no longer required for these purposes, it is deleted, anonymized, or otherwise securely disposed of as appropriate.

8. Information security

Fortunato.ph and its operator use reasonable organizational and technical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, or loss. Safeguards are selected according to the nature of the information and the risks involved and may include access restrictions, protected credentials, secure transport, system monitoring, backups, and controlled administrative access.

No method of internet transmission or electronic storage is completely secure. We regularly consider the safeguards appropriate to the nature of the information and the risks involved.

9. Your rights

Subject to the conditions and limitations under applicable law, you may exercise the right to be informed, the right of access, the right to object, the right to rectification, the right to erasure or blocking, the right to data portability where applicable, and the right to damages. You may also lodge a complaint with the National Privacy Commission.

10. Cookies and analytics

With your permission, we use Google Analytics 4 on the homepage and certain designated public pages to understand website usage and improve the visitor experience. Google Analytics may use cookies or similar browser technologies to distinguish visits and produce aggregated usage reports. Optional analytics is disabled unless you consent through our Cookie Preferences controls.

You may reject optional analytics, change your preference, or withdraw consent at any time through the Cookie Preferences link in the public website footer. Withdrawing consent stops subsequent analytics collection and removes accessible Google Analytics cookies used by this website. Your choice does not prevent submission of public inquiry or demonstration-request forms.

11. International processing

Some service providers, including Google Analytics, infrastructure providers, and email-delivery providers, may process or make information accessible outside the Philippines. Where cross-border processing occurs, we take reasonable steps to apply contractual, organizational, and technical safeguards appropriate to the processing and applicable requirements.

The locations involved depend on the service provider and deployment used for the relevant service. NxtStory Studios Inc.'s operations in the United States do not, by themselves, mean that Fortunato.ph customer data is hosted in or transferred to the United States.

12. Changes to this notice

We may update this notice to reflect changes in our services, processing activities, service providers, or legal obligations. Material revisions will be posted on this page with an updated revision date and, where appropriate, communicated through additional channels.
